These Terms & Conditions govern your use of the DS Graphics website and any custom products or services provided by DS Graphics. By using this website, requesting a quote, approving artwork, or placing an order with DS Graphics, you agree to these terms.

Custom Orders

DS Graphics provides custom apparel, embroidery, hats, decals, graphics, and related products and services.

Because most products are customized specifically for each customer, order details, pricing, quantities, turnaround times, payment requirements, and other project-specific terms may be provided separately through a quote, invoice, email, or written agreement.

The terms provided with a specific quote or order will apply in addition to these general Terms & Conditions.

Quotes and Pricing

Quotes are based on the information available at the time they are prepared, including quantities, garment or product selection, artwork requirements, printing or embroidery methods, and other project specifications.

Pricing may change if the scope of the project changes, including changes to:

• Quantity

• Product or garment selection

• Artwork or design requirements

• Number of print or embroidery locations

• Colors

• Sizes

• Shipping or delivery requirements

• Production specifications

DS Graphics will communicate significant pricing changes before proceeding whenever reasonably possible.

Artwork and Design Approval

Customers are responsible for reviewing and approving artwork, spelling, names, numbers, colors, placement, sizing, and other design details before production begins.

Once artwork has been approved, DS Graphics is not responsible for errors that were present in the approved design.

Customers should carefully review all proofs before giving final approval.

Customer-Supplied Logos and Artwork

When you provide DS Graphics with a logo, photograph, design, trademark, graphic, or other artwork, you represent that you own the material or have permission to use and reproduce it.

DS Graphics assumes no responsibility for copyright, trademark, licensing, or other intellectual property disputes resulting from customer-supplied artwork.

The customer agrees to be responsible for claims resulting from materials they provided without proper authorization.

Artwork Created by DS Graphics

Artwork, layouts, mockups, design concepts, digitized embroidery files, production files, and other materials created by DS Graphics may remain the property of DS Graphics unless ownership is specifically transferred in writing.

Payment for a finished product does not automatically transfer ownership of working files, production files, embroidery digitizing files, design templates, or other internal production materials.

Customers may contact DS Graphics if they would like to discuss purchasing or receiving specific design files.

Production Variations

Custom manufacturing processes may result in minor variations between products or between different production runs.

These variations may include differences in:

• Print placement

• Embroidery placement

• Thread color

• Garment color

• Print color

• Product sizing

• Material texture

• Manufacturer specifications

Colors displayed on computer monitors, phones, or digital proofs may also appear slightly different from the final physical product.

Minor production variations are considered normal and are not necessarily defects.

Product Availability

Apparel styles, colors, sizes, hats, materials, and other products may be subject to supplier availability.

If a requested product becomes unavailable, DS Graphics may recommend a comparable substitute. Any significant substitution will be discussed with the customer before production.

Turnaround Times

Estimated completion dates and turnaround times are provided as estimates unless DS Graphics specifically agrees to a guaranteed deadline in writing.

Production may occasionally be affected by supplier delays, shipping delays, equipment issues, artwork revisions, customer approval delays, or circumstances beyond the reasonable control of DS Graphics.

Customers should inform DS Graphics of event dates or firm deadlines before placing an order.

Changes and Cancellations

Because custom products are made specifically for each customer, changes or cancellations may not be possible once materials have been ordered or production has begun.

Customers may be responsible for costs already incurred by DS Graphics, including:

• Purchased garments or materials

• Design work

• Artwork preparation

• Embroidery digitizing

• Printing setup

• Production already completed

Any cancellation or change request should be made as soon as possible.

Payment

Payment terms will be communicated through the applicable quote, invoice, or order agreement.

DS Graphics may require partial or full payment before ordering materials or beginning production.

Orders may be withheld until required payments have been received.

Returns and Custom Products

Because customized products are made specifically for the customer, custom orders are generally not returnable because of a change of mind, incorrect size selection, or customer-approved design decisions.

If DS Graphics makes an error or a product is defective, customers should contact us as soon as reasonably possible so we can review the issue and determine an appropriate solution.

DS Graphics may request photographs or return of the affected items before providing a replacement, correction, credit, or other remedy.

Customer-Supplied Items

If DS Graphics agrees to decorate, embroider, print, or otherwise modify customer-supplied garments or products, the customer understands that production processes involve some risk.

While reasonable care will be taken, DS Graphics cannot guarantee replacement of customer-supplied items in the event of damage during production unless otherwise agreed in writing.

Use of Completed Work

Unless a customer specifically requests otherwise, DS Graphics may photograph completed projects and display examples of its work on its website, social media pages, portfolio, or other promotional materials.

If you do not want your project photographed or publicly displayed, please notify DS Graphics before or during the project.

Information on this website is provided for general informational purposes.

DS Graphics makes reasonable efforts to keep website information accurate but does not guarantee that all descriptions, images, pricing information, or other content will always be complete, current, or error-free.

Website content may be changed or updated without notice.

Intellectual Property

Unless otherwise indicated, the DS Graphics name, branding, website design, text, graphics, photographs, and original website content are owned by DS Graphics or used with permission.

The DS Graphics website may include links to Facebook or other third-party websites and services.

DS Graphics does not control and is not responsible for the content, availability, privacy practices, or terms of third-party websites.

Governing Law

These Terms & Conditions are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles.

Changes to These Terms

DS Graphics may update these Terms & Conditions from time to time.

Updated terms will be posted on this page with a revised effective date.
